Terms of Service

- Service. The Prompt Smiths ("we") creates AI-generated images, short videos and captions ("Deliverables") of fictional characters for clients ("you").
- Your materials. You confirm you own or have permission to use everything you send us, and that your character is fictional and adult, or that you have written consent from any real person depicted. You're responsible for how you use the Deliverables.
- Content rules. We don't create content involving minors, explicit sexual content, real people without their consent, or anything illegal, hateful, deceptive or infringing. We may refuse or stop work at our discretion.
- Plans and payment. Plans are billed weekly with a 4-week minimum, invoiced in advance. After the minimum, either party may cancel with 7 days' notice. Free samples carry no obligation.
- Revisions. Each plan includes the revision rounds listed on the pricing page. Extra revisions or new characters may cost extra.
- Ownership and license. When a week is paid in full, you may use that week's Deliverables for any lawful purpose, including commercial use. Deliverables are made with third-party AI tools and may be subject to those tools' terms. We don't guarantee exclusivity of style, and we can't guarantee that AI-generated content is protectable by copyright.
- AI disclosure. You agree to label AI-generated content where the law or a platform requires it.
- Portfolio. We'll only show your Deliverables in our portfolio with your permission.
- No warranty; limit of liability. Deliverables are provided "as is." Our total liability is limited to the amount you paid in the 4 weeks before the claim.
- Changes. We may update these terms and will note the date above.
